INTELLECTUAL PROPERTY & DMCA POLICY

HalaPOD Store respects the intellectual property rights of others and expects our users and partners to do the same. We operate an online store selling customized merchandise and strictly prohibit the listing or sale of items that infringe on the intellectual property rights of third parties, including but not limited to copyrights, trademarks, and patents.

In accordance with the Digital Millennium Copyright Act (DMCA), we will respond promptly to specific notices of copyright infringement that comply with the applicable laws.


A. Procedure for Reporting Intellectual Property Infringement

If you believe that your intellectual property rights have been violated by content on HalaPOD Store, please follow the procedure outlined below. Upon receipt of a valid and complete notice, we will:

  • Remove or disable access to the infringing content (text, images, or designs).
  • Notify the responsible party that the content has been removed.
  • Terminate services for repeat offenders.

To file a formal infringement notice, please provide the following information to our Designated Agent:

  1. Identification of the Work: A description of the copyrighted work or intellectual property you claim has been infringed (including registration numbers, if applicable).
  2. Identification of the Material: A description of the specific content you believe infringes your rights, along with the exact URL(s) where the content is located on HalaPOD Store.
  3. Contact Information: Your full name, mailing address, telephone number, and email address.
  4. Good Faith Statement: A statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
  5. Perjury Statement: A statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.
  6. Signature: Your electronic or physical signature.

B. Procedure to Submit a Counter-Notice

If you believe that your content was removed or disabled by mistake or misidentification, or that you have authorization to use the content (e.g., from the rights owner or under fair use law), you may submit a counter-notice to our Designated Agent containing:

  1. Identification of the Material: A description of the content that was removed and its location (URL) on HalaPOD Store before it was removed.
  2. Perjury Statement: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  3. Contact Information: Your name, address, phone number, and email address.
  4. Consent to Jurisdiction: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or Dallas, Texas, if you are outside the USA), and that you will accept service of process from the person who provided the original infringement notification.
  5. Signature: Your electronic or physical signature.

*Upon receiving a valid counter-notice, HalaPOD Store may forward it to the original complainant. If the complainant does not file a court action within 10-14 business days, we may restore the removed content at our discretion.


C. False Claims & Liability

Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing, or was removed or disabled by mistake, may be held liable for damages, including legal fees and costs incurred by the alleged infringer or by HalaPOD Store.
